These Terms of Use (“Terms”) govern your access to and use of the InferPheno application, website, services, assessments, reports, digital products, and related features (“InferPheno” or the “Services”) provided by ProXplor PTE. LTD. (“ProXplor,” “we,” “us,” or “our”).

By accessing or using InferPheno, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use InferPheno.

1. About InferPheno

InferPheno is a smartphone-powered digital active health management product developed by ProXplor.

InferPheno is designed to support health intelligence, digital phenotype analysis, visual phenotype analysis, functional-state understanding, active health management, reassessment-based health intelligence, and wellness-related decision-support workflows.

InferPheno may use user-provided profile information, health-related inputs, user-submitted images, assessment records, digital interaction data, and other relevant information to generate health intelligence outputs, reports, and reassessment-based insights.

2. Eligibility

You may use InferPheno only if you are legally permitted to use digital services under the laws applicable to you.

If you are under the minimum age required by applicable law to provide consent for digital services, you may use InferPheno only with the consent and supervision of a parent or legal guardian.

By using InferPheno, you represent that you have the legal capacity to agree to these Terms or that your parent or legal guardian has agreed to these Terms on your behalf.

3. Account Registration and User Information

Certain InferPheno features may require users to create an account or provide profile information.

You agree to provide accurate, complete, and up-to-date information when using InferPheno, including where applicable:

• Display name;

• Gender;

• Date of birth;

• City or region of long-term residence;

• Phone number;

• Email address;

• User-submitted images;

• Health-related inputs or assessment information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must not impersonate another person, create an account using false information, or use another user’s account without authorization.

4. User-Submitted Images

InferPheno may require users to submit specific images to support its intended health intelligence features, including:

• Front-facing facial image;

• Side-facing facial image;

• Front-facing tongue image.

These images are used only for visual phenotype analysis, health-state understanding, functional-state interpretation, reassessment-based health intelligence, and active health management features.

You agree that:

• You will upload only images that are necessary for InferPheno’s intended functionality;

• You will not upload images of another person unless you have the appropriate authorization;

• You will not upload unlawful, misleading, offensive, manipulated, or irrelevant images;

• You understand that image-based analysis is used for health intelligence support and does not constitute medical diagnosis.

InferPheno does not use user-submitted facial images for identity verification, face recognition, biometric identification, surveillance, advertising tracking, or cross-app tracking.

InferPheno does not create or use facial recognition templates, facial identity profiles, biometric identifiers, or biometric templates from user-submitted images.

5. Health and Medical Boundary

InferPheno is designed to support health intelligence, functional-state interpretation, digital phenotype analysis, visual phenotype analysis, active health management, wellness optimization, and decision-support workflows.

InferPheno is not a medical device unless expressly stated and approved under applicable laws.

InferPheno does not provide medical diagnosis, disease confirmation, emergency medical advice, prescription treatment, or medical treatment plans.

InferPheno is not intended to replace licensed medical professionals, clinical diagnosis, emergency care, prescribed medical treatment, or professional medical judgment.

Any health intelligence output, report, interpretation, recommendation, or reassessment result provided by InferPheno is for informational, wellness, active health management, and decision-support purposes only.

If you have potential medical risks, urgent symptoms, clinically significant conditions, or medical concerns, you should consult a qualified healthcare professional.

In the event of a medical emergency, you should contact local emergency services immediately.

6. User Responsibility

You are responsible for how you use InferPheno and how you interpret or act upon any information provided through the Services.

You agree that you will not:

• Use InferPheno as a substitute for medical diagnosis or treatment;

• Ignore professional medical advice because of information provided by InferPheno;

• Delay seeking medical care because of information provided by InferPheno;

• Use InferPheno for emergency medical situations;

• Use InferPheno to diagnose, treat, cure, prevent, or manage diseases without professional medical guidance;

• Provide false, incomplete, misleading, or unauthorized information or images;

• Misuse the Services in any way that may harm ProXplor, other users, service providers, or third parties.

7. Privacy and Data Use

Your use of InferPheno is also governed by the InferPheno Privacy Policy, which explains how ProXplor collects, uses, stores, protects, and manages personal data, health-related information, user-submitted images, and digital interaction data.

By using InferPheno, you acknowledge that you have read and understood the InferPheno Privacy Policy.

8. Access Codes, Paid Features, and Subscriptions

InferPheno may offer free features, paid features, subscriptions, service packages, access codes, enterprise access, or other usage-based service models.

Certain features may require payment, subscription activation, enterprise authorization, or valid access credentials.

Where payments are processed through Apple App Store, Google Play, or other approved payment channels, the payment, refund, cancellation, and billing terms of the relevant platform or payment provider may apply.

Access codes, if provided, are intended only to unlock authorized InferPheno features, credits, service access, or approved usage rights. Access codes must not be sold, transferred, misused, duplicated, or obtained through unauthorized channels.

ProXplor may suspend, revoke, or refuse access to features, credits, subscriptions, or access codes if we reasonably believe there has been fraud, abuse, unauthorized transfer, violation of these Terms, or misuse of the Services.

9. Acceptable Use

You agree not to use InferPheno to:

• Violate any applicable law, regulation, platform rule, or third-party right;

• Upload unlawful, harmful, misleading, offensive, or unauthorized content;

• Interfere with or disrupt the operation, security, or integrity of the Services;

• Attempt to reverse engineer, decompile, copy, scrape, or extract source code, models, data structures, reports, or system logic except where permitted by law;

• Circumvent access controls, payment systems, access codes, security features, or usage limits;

• Use automated systems, bots, scripts, or unauthorized tools to access or manipulate the Services;

• Use InferPheno outputs to provide unauthorized medical, clinical, diagnostic, or treatment services;

• Misrepresent InferPheno outputs as clinical diagnosis, medical certification, or professional medical advice.

10. Intellectual Property

InferPheno, including its software, interface, design, technology, models, workflows, reports, text, graphics, logos, trademarks, product names, frameworks, and other content, is owned by ProXplor or its licensors and is protected by applicable intellectual property laws.

Subject to your compliance with these Terms, ProXplor grants you a limited, non-exclusive, non-transferable, revocable license to use InferPheno for personal, internal, or authorized organizational purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, reproduce, publish, or create derivative works based on InferPheno or its content unless expressly authorized by ProXplor.

11. User Content and License

You retain any rights you may have in content, images, information, or materials that you submit to InferPheno.

By submitting content, images, or information to InferPheno, you grant ProXplor a limited license to process, analyze, store, display, generate reports from, and otherwise use such content only as necessary to provide, maintain, improve, secure, and operate the Services, in accordance with these Terms and the InferPheno Privacy Policy.

This license does not allow ProXplor to sell your personal data, health-related information, or user-submitted images.

12. Reports and Outputs

InferPheno may generate health intelligence reports, visual phenotype analysis outputs, functional-state interpretations, reassessment records, wellness-related suggestions, or other digital outputs.

You understand and agree that:

• Reports and outputs are generated based on available user-provided information, images, system logic, and analytical models;

• Reports and outputs may be incomplete, inaccurate, or affected by image quality, lighting, user input quality, technical limitations, model limitations, or contextual factors;

• Reports and outputs are not medical diagnosis, clinical examination, laboratory testing, disease confirmation, or treatment instruction;

• Reports and outputs should be used as supportive information for active health management and wellness awareness.

ProXplor does not guarantee that any report, output, recommendation, or interpretation will be complete, error-free, medically definitive, or suitable for all users or circumstances.

13. Enterprise, Institutional, and Partner Use

InferPheno may be used in enterprise, institutional, partner, or authorized organizational settings.

Where InferPheno is used by or through an organization, partner, institution, service provider, or enterprise client, additional agreements, service terms, data processing arrangements, consent mechanisms, or compliance obligations may apply.

For customized cooperation with clinical institutions, medical institutions, or service scenarios involving clinical services, relevant partners are responsible for completing the required medical, data, privacy, professional licensing, and other applicable compliance procedures according to their jurisdiction, business model, and service scope.

14. Third-Party Services

InferPheno may rely on third-party services, infrastructure providers, cloud services, analytics tools, payment providers, app stores, or technical service providers.

Your use of third-party services may be subject to the terms and privacy policies of those third parties.

ProXplor is not responsible for third-party services that are not under our control, except as required by applicable law.

15. Availability and Changes to the Services

ProXplor may update, modify, suspend, restrict, or discontinue any part of InferPheno at any time, with or without notice, subject to applicable laws and platform rules.

We may also change features, workflows, reports, access models, pricing, availability, or technical requirements.

We do not guarantee that InferPheno will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, region, or user environment.

16. Suspension and Termination

ProXplor may suspend, restrict, or terminate your access to InferPheno if we reasonably believe that:

• You have violated these Terms;

• You have provided false, misleading, unauthorized, or harmful information;

• You have misused the Services, access codes, payment systems, or technical systems;

• Your use may create legal, security, privacy, safety, operational, or reputational risks;

• Suspension or termination is required by law, platform rules, or service provider requirements.

You may stop using InferPheno at any time.

17. Disclaimer of Warranties

InferPheno is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, ProXplor disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, security, or error-free operation.

ProXplor does not warrant that InferPheno will meet your expectations or that any report, output, analysis, recommendation, or interpretation will be accurate, complete, medically definitive, or suitable for your specific circumstances.

18. Limitation of Liability

To the maximum extent permitted by applicable law, ProXplor and its directors, officers, employees, contractors, partners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or economic damages arising from or related to your use of InferPheno.

This includes, without limitation, damages related to loss of data, loss of profits, service interruption, inaccurate outputs, user decisions, health-related actions, reliance on reports, unauthorized access, or inability to use the Services.

Nothing in these Terms limits liability that cannot be limited under applicable law.

19. Indemnity

You agree to indemnify and hold harmless ProXplor, its directors, officers, employees, contractors, affiliates, partners, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses arising from or related to:

• Your use or misuse of InferPheno;

• Your violation of these Terms;

• Your violation of applicable laws or third-party rights;

• Your submission of false, misleading, unauthorized, or unlawful information or images;

• Your use of InferPheno outputs in unauthorized medical, clinical, commercial, or professional contexts.

20. Governing Law

These Terms are governed by the laws of Singapore, unless otherwise required by applicable consumer protection laws or mandatory local laws.

Any disputes arising from or related to these Terms or your use of InferPheno shall be resolved in accordance with applicable laws and competent dispute resolution procedures.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, technology, legal requirements, platform requirements, business operations, or user needs.

When we make material changes, we will notify users through the app, website, or other appropriate channels.

Your continued use of InferPheno after the updated Terms become effective means that you accept the updated Terms.
